Homes
in Foreclosure
When
a property owner does not make their payments in California, the
first step in the foreclosure
process is the Notice of Default (NOD). Once a NOD has
been filed, the owner has approximately four months to negotiate
with the lender, bring the payments current, or sell the
property to avoid a TRUSTEE'S SALE.
If
the property owner elects to sell the property, he/she will very
often list with a Realtor to achieve a quick sale as close to market
value as possible.

Bank
Owned Homes - Also Know as Real Estate Owned (REOs)
If
a property goes into default and ultimately to Trustee's Sale
sometimes the loan balance exceeds the market value. In these
cases there will be no bidders and the lender will obtain title to
the home by default via Trustee's Deed.
With
the increase in homes in foreclosure, it is inevitable that some
will make it all the way through foreclosure and become Bank Owned.
(Banks and Realtors call these properties REOs - which stands for
the Real Estate Owned category on the Bank's Financial Balance
Sheet).
In
almost all cases Banks list their REO properties with Realtors to show auditors and
regulators that the bank is exercising its fiduciary duty to protect
stockholders

Probate
Sales
When a property owner passes away, it is
sometimes necessary to dispose of the property owned by the estate
using a statutory process known as "Probate".
Probate Sales are As-Is, they are
exempted from most disclosure requirements, and sometimes require
court confirmation.
Probate Sales are almost always
listed with Realtors to show the judge and heirs that the executor
exercised his fiduciary responsibility to the estate.

Short
Sales
A "Short Sales" is where
the existing loan balance on a home exceeds the market value of the
property. These properties are also known as
"Pre-Foreclosure" sales as often the owner is trying to do
a short sale to avoid foreclosure.
When the owner of the property (seller)
cooperates it is often possible to have the bank lower the mortgage
balance to facilitate the sale of the property at a bargain price.

Please be aware that only 25 to 50%
of all short sales are approved by the Bank; therefore, completing
these purchases is not certain and can take months. Many of
our buyer clients have been very disappointed with the time required
to complete short sale purchases.

Relocation
Sales also known as RELOs
When
an executive is transferred by a large corporation, sometimes the
executive is offered a relocation package. As a part of the
relocation package, the executive's existing home is purchased by a
relocation company (funded by the employer) so the executive can
quickly purchase a new home in the new city of employment.
The
relocation company will obtain an ERC (Employee Relocation Council)
Appraisal of the property. The Appraisal will be used to set
the buy-out price paid to the executive, and the goal of the
relocation company is to sell the property for a price as close to
the ERC Appraisal as possible.
The
relocation company will hire a Realtor and manage the sale of the
executive's old home minimizing the monetary cost to the executive's
employer.

Auctions
Occasionally
some homeowners and builders elect to Auction their homes to bring
about a very quick sale. I have represented three winning

Fixer-Uppers
Some
properties are in such poor condition that they need substantial
improvements before a family can move-in. Such properties
typically sell for a discount because many buyers are not willing or
able to effect the necessary repairs. Another issue is that
the repairs cannot be financed in the purchase loan since the fix-up
work cannot be completed until after close of escrow.
These
properties are often a good buying opportunity.
